Version of 23 October 2026. Each order is governed by the Terms published on the day it is sent.to be confirmed
Art. 1 – Who these Terms apply to
These General Terms of Sale (the “Terms”) govern orders for the products on the Site (the “Products”) between the Seller and the buyer (the “Customer”).
The Site is reserved for professional operators: restaurants, foodservice businesses and other food business operators. At checkout the Customer provides the company name, VAT number and SDI code or PEC for the electronic invoice.
If the purchase is made by a consumer within the meaning of the Italian Consumer Code (Legislative Decree 206/2005), all the protections the law grants them, which cannot be limited, remain in force: the clauses of these Terms that concern professionals only do not apply to consumers.
Orders placed on WhatsApp or by phone are governed by these Terms.
By sending an order the Customer declares that they have read and accepted these Terms.
Art. 2 – How the contract is concluded
The Products shown on the Site are an invitation to treat. The order sent by the Customer through the Site’s procedure is a purchase proposal. The contract is concluded when the Seller sends the Customer the order confirmation at the email address given in the order. The automatic email acknowledging receipt of the order is not the confirmation: the confirmation follows the Seller’s check.
Before sending the order, the Customer can check and correct the data in the summary. The contract is in Italian. These Terms remain published on this page and the Customer can save or print them.
The Seller may decline an order, for example if the billing details are incomplete or the delivery area is not served: in that case it informs the Customer and cancels the payment authorisation without any charge.
Art. 3 – Products, cases and weight
The Products are sold by the case. The case contains pieces cut from the fish, so its weight varies: for each Product the Site shows the indicative case weight, the maximum weight and the price per kilo.
Every case is weighed before shipping. The Customer pays the actual weight, shown on the delivery note and on the invoice.
Product images are for illustration only. The characteristics of each batch (fishing area, dates, fishing gear) are shown on the traceability sheet linked to the QR code on the case.
Art. 4 – Prices and payment
Prices are in euros and exclude VAT. VAT is calculated at checkout at the statutory rate. Shipping costs are shown before the order is confirmed.
Payment is made online, by payment card. When the order is placed, the amount corresponding to the maximum weight of the cases ordered is authorised; after weighing, only the amount for the actual weight is charged, and the unused part of the authorisation is released according to the timing of the payment network.
Payments are handled by specialised providers: the Seller does not see or store full card details.
The electronic invoice is issued on the actual weight and sent through the Italian Interchange System (Sistema di Interscambio, SdI) to the SDI code or PEC given by the Customer.
Art. 5 – Availability
The Products are perishable and the availability shown on the Site is indicative. If, after the order confirmation, a Product is not available, the Seller informs the Customer and cancels the payment authorisation or refunds any amount charged within 2 working days.
Art. 6 – Shipping and cold chain
Deliveries are made in Italy by express courier (GLS), in insulated packaging with dry ice that keeps the Products frozen until delivery. Orders placed on the Site are delivered in mainland Italy as far as Puglia, Basilicata and Campania; for Calabria, Sicily and Sardinia the order and delivery are agreed directly with the Seller.
Delivery times depend on the area and are shown on the Site based on the postcode of the premises. At checkout the Customer can indicate the preferred delivery day and time slot and a phone number for the courier. Times are indicative and may vary for reasons beyond the Seller’s control (strikes, weather conditions, extraordinary events).
The Customer guarantees that a person authorised to receive the goods will be present at the address and in the time slot indicated.
Art. 7 – On delivery
The risk of deterioration of the Products passes to the Customer when the Customer, or a person they have authorised, receives the goods.
On delivery the Customer checks:
- that the number of cases matches the delivery note;
- that the packaging is intact, not wet or damaged, with no signs of thawing.
If they find an anomaly, the Customer notes it on the courier’s document («accettato con riserva», i.e. accepted with reservation, and the reason) and reports it immediately to the Seller at info@antaresitalia.eu, with some photos.
After delivery the Customer immediately places the Products in a freezer at −20 °C or below. The Seller is not liable for deterioration due to delays in storage or to unsuitable storage after delivery. Instructions for thawing the Products are on the Site.
Dry ice must not be touched with bare hands: leave it to evaporate in a ventilated room.
Art. 8 – Complaints and warranty
The Seller guarantees that the Products comply with food hygiene rules and with the Product’s technical sheet.
The professional Customer reports defects visible on delivery within 24 hours of delivery, and defects found on thawing within 24 hours of their discovery, before using the Product and keeping the case and label. They write to info@antaresitalia.eu or to the PEC antarestrading@pec.it, with:
- order number and delivery date;
- a description of the problem;
- photos and videos showing the case label (with the batch) and the defect.
If the Seller’s quality control, based on the photos and videos received, confirms the defect, the Seller, at its choice, replaces the Product or refunds the price paid for the defective case. In relations between professionals any further compensation is excluded, except in cases of wilful misconduct or gross negligence and except for what the law does not allow to be excluded, including liability for damage caused by defective products.
Consumers are covered by the legal guarantee of conformity under Articles 128 et seq. of the Italian Consumer Code.
Art. 8-bis – First-order trial
On a new professional Customer’s first order, one case is covered by the trial: if the Product, stored at −20 °C and thawed following the protocol published on the Site, does not satisfy the Customer, the Customer reports it within 48 hours of delivery with photos and, if possible, a video of the thawing. The Seller replaces the case or refunds its price. The trial does not concern defects, for which Art. 8 applies.
Art. 9 – Withdrawal
The right of withdrawal under the Italian Consumer Code concerns consumers only. For the Products sold on the Site it is excluded under Article 59(1)(d) of the Consumer Code: they are quick-frozen goods that deteriorate rapidly outside the cold chain, and the Seller cannot check how they were stored after delivery.
Art. 10 – Customer account
You don’t need to register to order. The Customer can create an account to see their orders, download documents and reorder. The Customer keeps their credentials safe and is responsible for the use of the account.
Art. 11 – Personal data
The Customer’s data is processed according to the Site’s Privacy policy.
Art. 12 – Governing law and jurisdiction
The contract is governed by Italian law.
For disputes with a professional Customer, the Court of Teramo has exclusive jurisdiction. For disputes with a consumer, the court of the place where the consumer resides or is domiciled has jurisdiction, if in Italy.
Art. 13 – Specific approval
Under Articles 1341 and 1342 of the Italian Civil Code, the professional Customer specifically approves, with the dedicated box at checkout, Articles 2 (the Seller’s right not to accept the order), 7 (passing of risk and obligations on delivery), 8 (complaint deadlines and limits of liability) and 12 (exclusive jurisdiction of the Court of Teramo).
